About these terms

These terms are an agreement between you and Lucky Jeagun, trading as CommonApps (“we” or “us”) about your use of BudgetSafe. By downloading or using BudgetSafe, you accept them. If you don’t agree, please don’t use the app.

Please also read the BudgetSafe privacy policy, which explains how your data is handled. Nothing in these terms takes away rights you have under the consumer laws of the country where you live.

Who can use the app

You must be at least 18, or the age of majority where you live if that is higher, to use BudgetSafe or buy Premium. You may use it only where doing so is allowed by the laws that apply to you.

What BudgetSafe is, and isn’t

BudgetSafe is a tool for recording and planning your own money. It is not financial advice. It doesn’t recommend financial products, it isn’t a regulated financial service, and it never connects to your bank or moves money.

  • The figures are only as good as what goes in. “Safe to spend”, budgets and forecasts are worked out from what you enter or import, and from your pay cycle settings. Check them against your bank statements before making important decisions.
  • Bank holidays come from the public list published by the UK government. We can’t guarantee it is always complete or up to date.
  • Your decisions are yours. You’re responsible for the financial choices you make. If you need advice, speak to a qualified adviser or a free, independent money guidance service where you live.

Importing statements

Only import statements you are entitled to use. Statement formats vary between banks, so BudgetSafe may not read every line correctly: review imported transactions before relying on them. Statement files are read on your device and aren’t uploaded anywhere.

Where BudgetSafe works

BudgetSafe is designed for the UK and works in pounds sterling. If you can download it elsewhere, it will work, but its pay-cycle rules and bank holidays follow UK patterns.

Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use BudgetSafe on devices you own or control, for your own non-commercial use, in line with the rules of the App Store or Google Play you got it from.

You must not:

  • copy, sell, rent, lend or distribute the app or its content;
  • reverse engineer, decompile or modify the app, except where the law allows you to;
  • try to get around its security, encryption or Premium checks;
  • use it in any way that breaks the law.

Premium subscriptions

BudgetSafe is free to download. Some features need a Premium subscription, which is sold and billed by Apple or Google, not by us, and is linked to your App Store or Google Play account.

  • Price. The price and billing period are shown in the app and the store before you buy, in your local currency including any taxes that apply.
  • Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged for the renewal within the 24 hours before the current period ends.
  • Free trials. If you start a free trial, the subscription starts and you’re charged when the trial ends, unless you cancel at least 24 hours before it ends.
  • Cancelling. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancelling stops the next renewal; Premium stays on until the end of the period you’ve paid for. Deleting the app doesn’t cancel a subscription.
  • Refunds. Apple and Google handle refunds under their own policies. This doesn’t affect any right you have under the law where you live, including any right to cancel and get your money back. Where you have such a right, you can use it through Apple or Google, or ask us for help.
  • Price changes. If the price changes, Apple or Google will tell you in advance and, where the law or their rules require it, ask you to agree before you’re charged the new price.
  • Checking in. Premium needs to go online now and then to confirm your subscription.

Your data and backups

What you put into BudgetSafe is stored on your device. We can’t see it, and we can’t recover or restore it for you. If you want a copy, use the app’s backup. If you use encrypted backup, keep your passphrase and recovery key safe: without them nobody can open the backup, including us. The privacy policy explains the details.

Changes to the app

We may update BudgetSafe to fix problems, improve it, or meet legal or store requirements, and some updates may be needed to keep using it. We may also change or stop offering features. If we stop offering Premium features you have paid for, we’ll tell you in advance, and you may be entitled to a refund for the unused part of your subscription.

We may update these terms. We’ll change the date at the top, and if a change is significant we’ll tell you in the app before it takes effect. If you don’t agree with a change, you can stop using the app and cancel Premium.

Who owns what

The app and its design, text, illustrations, animations and other content belong to us or the people we license them from, and are protected by intellectual property laws. These terms don’t give you any rights to them other than the licence above. The data you put into the app is yours. If you send us ideas or feedback, we may use them freely.

What we promise, and what we don’t

We make BudgetSafe with care, and it should match its description in the store. Apart from that, and only to the extent the law allows, the app is provided “as is” and “as available”: we don’t promise it will always be available, free of errors, or suitable for every purpose. Some countries don’t allow these exclusions. Where that’s the case, they don’t apply to you, and you keep every right the law gives you.

Our responsibility to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law that applies to you.

Subject to that, and only to the extent the law allows:

  • we’re not responsible for loss or damage that wasn’t reasonably foreseeable, or that was caused by events outside our reasonable control;
  • we’re not responsible for business losses, because the app is for personal use only;
  • we’re not responsible for losing data you didn’t back up, or for losses caused by not following the app’s instructions or these terms;
  • our total liability to you for all claims is limited to the greater of what you paid for Premium in the 12 months before the claim, or the equivalent of US$50.

These limits don’t affect your legal rights as a consumer.

Ending these terms

You can stop using BudgetSafe at any time by deleting it; remember to cancel Premium in your store account too. We may end your licence if you seriously or repeatedly break these terms. Parts of these terms that are meant to continue, such as “Who owns what” and “Our responsibility to you”, continue after they end.

Apple and Google

If you downloaded BudgetSafe from Apple’s App Store:

  • These terms are between you and us only, not Apple. We, not Apple, are responsible for the app and its content.
  • Your use of the app must also follow the Usage Rules in Apple’s Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for any claims about the app or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • You must follow any third-party terms that apply when you use the app, such as your mobile network’s.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple may enforce them against you.

If you downloaded BudgetSafe from Google Play, Google Play’s terms of service also apply to your download and any purchases.

Which laws apply

These terms are governed by the laws of the country where we are established. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and nothing in these terms takes that away. You can bring a claim in the courts of the country where you live, or of the country where we are established.

We’d always rather sort things out directly first. If something goes wrong, please email us and we’ll try to put it right quickly.

Other important terms

  • If a court finds part of these terms invalid, the rest still applies.
  • If we don’t enforce a term straight away, we can still enforce it later.
  • These terms, the privacy policy and the store’s terms are the whole agreement between you and us about the app.
  • We may transfer our rights and obligations under these terms to another organisation, for example if the app is sold. We’ll tell you, and it won’t reduce your rights. You may not transfer yours without our agreement.
  • Apart from Apple and its subsidiaries as set out above, nobody else has rights under these terms.
